These Terms of Service (“Terms”) form a legally binding agreement between you (“you,” “customer,” or “user”) and BebeHawaii LLC (“Company,” “we,” “us,” or “our”) governing all access to, and purchases from, BebeHawaii.com (the “Site”). By browsing, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms as well as our Privacy PolicyCookie PolicyShipping Policy, Refund & Returns Policy, Payment Methods, and Secure Shopping pages (collectively, the “Policies”), which are incorporated herein by reference.

If you do not agree, please do not use the Site.


1. Definitions

“Goods”Made-to-order Hawaiian shirts (sizes S–6XL) and any related accessories offered for sale on the Site.
“Business Day(s)”Monday through Saturday, excluding U.S. federal holidays.
“Order Processing Time”3–5 Business Days required to print, quality-check, and pack your shirt.
“Delivery Window”9–15 Business Days in transit via USPS Ground Advantage or UPS Ground, after Order Processing Time.

2. Eligibility

You must be at least 18 years old (or the age of majority in your state) and capable of entering a binding contract to use this Site. We currently sell and ship only to addresses within the United States, including APO/FPO/DPO.


3. Products & Production

  1. Made-to-Order Model. Each shirt is printed after you complete payment; no pre-printed stock exists.
  2. Lead Times. Order Processing Time is 3–5 Business Days; minor delays may occur during peak seasons.
  3. Tolerances. Size measurements may vary by ± 1 inch. Slight color variations between digital proofs and fabric are normal due to monitor calibration and print method.

4. Pricing, Taxes, and Promotions

  • All prices are listed in U.S. Dollars (USD).
  • Applicable state and local sales tax is calculated at checkout using your ZIP code.
  • Promotional codes must be entered at checkout; they cannot be applied retroactively.
  • We reserve the right to correct pricing errors and to discontinue or modify promotions at any time without prior notice.

5. Orders & Payment

AuthorizationYour card is authorized immediately; funds are captured within 24 hours once the order passes our fraud-screening system.
Order ConfirmationYou will receive an email with your order number, item details, and an estimated delivery date. If you do not receive confirmation within 30 minutes, contact support@bebehawaii.com.
Order ChangesEmail changes or cancellations to support within 12 hours of purchase. After production begins, size or design changes are not guaranteed.
Failed / Fraudulent PaymentsWe may cancel any order that fails payment authorization or triggers fraud-risk flags. Suspicious activity may be reported to the relevant authorities.

6. Shipping & Risk of Loss

  • Orders ≥ $200 qualify for free ground shipping; orders below this threshold incur a flat $4.95 fee
  • Delivery Window – 9–15 Business Days after Order Processing Time (total 12–20 calendar days).
  • Tracking – A clickable tracking link is emailed once your parcel departs our Claymont, DE facility.
  • Risk Transfer – Title and risk of loss pass to you when the carrier marks the package “Delivered.”
  • Lost or Damaged Parcels – Report within 7 days of the last tracking scan; we will file a carrier claim and reship or refund once confirmed.

7. Returns, Exchanges, and Refunds

  1. Return Window – 30 calendar days from the date your order is marked “Delivered.”
  2. Eligible Condition – New, unwashed, unaltered, tags attached, and free of odors/pet hair.
  3. Process – A prepaid USPS/UPS return label is included in your package. Ship the item back within the 30-day window.
  4. Refund Method – Original payment method, processed within 5–10 Business Days of receipt and inspection.
  5. Exchanges – One free size/design exchange per order, subject to stock availability.
  6. Non-Returnable Items – Gift cards, promotional giveaways, and items showing wear or laundering.

8. Intellectual Property

All designs, logos, images, text, and code on the Site are the exclusive property of BebeHawaii LLC or its licensors. You may not reproduce, distribute, modify, or create derivative works without prior written permission.


9. Acceptable Use

You agree not to:

  • Scrape, crawl, or harvest data from the Site.
  • Introduce malware, viruses, or harmful code.
  • Upload infringing, defamatory, or obscene material.
  • Use the Site for any illegal or unauthorized purpose.

Violation may result in suspension of your account and legal action.


10. Limited Warranty & Disclaimers

Manufacturing DefectsWe warrant that Goods will be free from print or stitching defects on arrival. Your sole remedy is repair, replacement, or refund, at our discretion.
No Other WarrantiesExcept for the express warranty above, Goods and Site are provided “as is” and “as available.” We disclaim all implied warranties, including fitness for a particular purpose.

11. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or Goods shall not exceed the purchase price of the specific order giving rise to the claim. We are not liable for indirect, consequential, punitive, or incidental damages.


12. Indemnification

You agree to indemnify, defend, and hold harmless BebeHawaii LLC and its officers, directors, employees, and agents from any claim, loss, or demand arising out of your misuse of the Site or breach of these Terms.


13. Governing Law & Dispute Resolution

  • Governing Law – State of Delaware, USA, without regard to conflict-of-law principles.
  • Good-Faith Negotiation – Contact us first; we aim to resolve disputes amicably within 30 days.
  • Arbitration – Unresolved disputes shall be settled by binding arbitration under AAA Consumer Arbitration Rules in Wilmington, DE. Either party may bring individual claims in small-claims court.
  • Class-Action Waiver – You may only resolve disputes with us on an individual basis.

14. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, labor strikes, carrier interruptions, or government orders.


15. Modifications to Terms

We may update these Terms for legal or operational reasons. Material changes will be emailed to registered customers 30 days in advance. Continued use of the Site after the effective date constitutes acceptance of the revised Terms.


16. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining sections remain in full force. These Terms, together with the incorporated Policies, constitute the entire agreement between you and BebeHawaii LLC.
