Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you (“you,” “customer,” or “user”) and BebeHawaii LLC (“Company,” “we,” “us,” or “our”) governing all access to, and purchases from, BebeHawaii.com (the “Site”). By browsing, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms as well as our Privacy Policy, Cookie Policy, Shipping Policy, Refund & Returns Policy, and Payment Methods (collectively, the “Policies”), which are incorporated herein by reference.
If you do not agree, please do not use the Site.


1. Definitions

2. Eligibility

You must be at least 18 years old (or the age of majority in your state) and capable of entering a binding contract to use the Site. We sell and ship only within the United States, including APO/FPO/DPO.


3. Products & Production

Made-to-Order Model. Each shirt is produced after you complete payment; no mass-production inventory exists.
Lead Times. Handling time is 3–5 Business Days; minor delays may occur during peak seasons.
Tolerances. Size measurements may vary by ±1 inch; slight color differences between digital previews and fabric are normal.


4. Pricing, Taxes, and Promotions

All prices are listed in U.S. Dollars (USD).
Applicable sales tax is calculated and shown at checkout based on your ZIP code.
Promotional codes must be entered at checkout and cannot be applied retroactively.
We may correct pricing errors and modify or discontinue promotions without prior notice.


5. Orders & Payment

Payment Methods. PayPal Wallet and major debit/credit cards (Visa, Mastercard, American Express, Discover) via the PayPal Commerce Platform.
Authorization. Your card may be authorized immediately; funds are captured once the order passes fraud screening.
Order Confirmation. You will receive an email with your order number, item details, and an estimated Delivery time: 12–20 Business Days. If you do not receive confirmation within 30 minutes, contact support@bebehawaii.com.
Order Changes. Email changes or cancellations to support within 12 hours of purchase. After production begins, changes are not guaranteed.
Failed / Fraudulent Payments. We may cancel any order that fails payment authorization or triggers fraud-risk flags.


6. Shipping & Risk of Loss

Delivery Area. We ship exclusively within the United States (APO/FPO/DPO supported).
Shipping Fee. Flat rate: $4.95 per order (US). We do not offer a free-shipping threshold.
Handling / Transit / Delivery.

  • Handling time: 3–5 Business Days (production + packing).
  • Transit time: 9–15 Business Days after carrier pickup.
  • Delivery time: 12–20 Business Days total.
    Tracking. A tracking link is emailed when your parcel departs our facility.
    Carriers. USPS, UPS, FedEx, YANWEN
    Risk Transfer. Title and risk of loss pass to you when the carrier marks the package “Delivered.”
    Lost or Damaged Parcels. Report issues within 7 days of the last tracking scan; we will file a carrier claim and reship or refund once confirmed.

7. Returns, Exchanges, and Refunds

Return window. 30 calendar days from delivery.
Eligible condition. New, unwashed, unaltered, tags attached, and free of odors/pet hair; original packaging and accessories included.
Non-returnable. Personalized/custom items are non-returnable unless defective or shipped in error; gift cards; items showing wear or laundering.
Process (RMA required). Email support@bebehawaii.com to obtain a Return Merchandise Authorization (RMA). Return method: by mail per the instructions provided. Returns sent without authorization may be delayed or not processed.
Return shipping fee. Customer pays return shipping (company error: we provide a prepaid return label).
Refund method & time. Refunds are issued to the original payment method, within 5 Business Days after receipt and inspection. Your bank/card issuer may take an additional 5–10 Business Days to post the amount.
Exchanges. Processed as a return + new order; our team can assist you in selecting a replacement if available.

8. Intellectual Property

All designs, logos, images, text, and code on the Site are the property of BebeHawaii LLC or its licensors. You may not reproduce, distribute, modify, or create derivative works without prior written permission.


9. Acceptable Use

You agree not to scrape, crawl, or harvest data from the Site; introduce malware or harmful code; upload infringing/defamatory/obscene material; or use the Site for any illegal or unauthorized purpose. We may suspend accounts and pursue legal remedies for violations.


10. Limited Warranty & Disclaimers

11. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or Goods shall not exceed the purchase price of the specific order giving rise to the claim. We are not liable for indirect, consequential, punitive, or incidental damages.


12. Indemnification

You agree to indemnify, defend, and hold harmless BebeHawaii LLC and its officers, directors, employees, and agents from any claim, loss, or demand arising out of your misuse of the Site or breach of these Terms.


13. Governing Law & Dispute Resolution

Governing Law. State of Delaware, USA, without regard to conflict-of-law principles.
Good-Faith Negotiation. Contact us first; we aim to resolve disputes amicably within 30 days.
Arbitration. Unresolved disputes shall be settled by binding arbitration under AAA Consumer Arbitration Rules in Wilmington, DE. Either party may bring individual claims in small-claims court.
Class-Action Waiver. You may only resolve disputes with us on an individual basis.


14. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, labor strikes, carrier interruptions, or government orders.


15. Modifications to Terms

We may update these Terms for legal or operational reasons. Material changes will be emailed to registered customers 30 days in advance. Continued use of the Site after the effective date constitutes acceptance of the revised Terms.


16. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining sections remain in full force. These Terms, together with the incorporated Policies, constitute the entire agreement between you and BebeHawaii LLC.
